What Can State Medical Boards Do to Effectively Address Serious Ethical Violations?Tristan McIntosh, Elizabeth Pendo, Heidi A. Walsh, Kari A. Baldwin, Patricia King, Emily E. Anderson, Catherine V. Caldicott, Jeffrey D. Carter, Sandra H. Johnson, Katherine Mathews, William A. Norcross, Dana C. Shaffer & James M. DuBois - 2023 - Journal of Law, Medicine and Ethics 51 (4):941-953.
State Medical Boards (SMBs) can take severe disciplinary actions (e.g., license revocation or suspension) against physicians who commit egregious wrongdoing in order to protect the public. However, there is noteworthy variability in the extent to which SMBs impose severe disciplinary action. In this manuscript, we present and synthesize a subset of 11 recommendations based on findings from our team’s larger consensus-building project that identified a list of 56 policies and legal provisions SMBs can use to better protect patients from egregious (...)

Structures of Opposition and Comparisons: Boolean and Gradual Cases.Didier Dubois, Henri Prade & Agnès Rico - 2020 - Logica Universalis 14 (1):115-149.
This paper first investigates logical characterizations of different structures of opposition that extend the square of opposition in a way or in another. Blanché’s hexagon of opposition is based on three disjoint sets. There are at least two meaningful cubes of opposition, proposed respectively by two of the authors and by Moretti, and pioneered by philosophers such as J. N. Keynes, W. E. Johnson, for the former, and H. Reichenbach for the latter. These cubes exhibit four and six squares of (...)

    IRB Decision-Making with Imperfect Knowledge: A Framework for Evidence-Based Research Ethics Review.Emily E. Anderson & James M. DuBois - 2012 - Journal of Law, Medicine and Ethics 40 (4):951-969.
Institutional Review Board decisions hinge on the availability and interpretation of information. This is demonstrated by the following well-known historical example. In 2001, 24-year-old Ellen Roche died from respiratory distress and organ failure as a result of her participation in a study at Johns Hopkins Asthma and Allergy Center. The non-therapeutic physiological study, “Mechanisms of Deep Inspiration-Induced Airway Relaxation,” was designed to examine airway hyperresponsiveness in healthy individuals in order to better understand the pathophysiology of asthma. Participants inhaled hexamethonium, a (...)

This collection of previously unpublished essays addresses a number of issues arising out of philosophical controversies over the possibility of genuine moral dilemmas. Issues addressed include the form of a moral dilemma; the paradoxes a moral dilemma is said to entail; the question of whether a moral dilemma must exhibit inconsistency; the role of intractable circumstances in occasioning moral dilemmas; and the plausibility of supposing that there might be rational ways of addressing moral dilemmas in practice. The contributors, writing from (...)

  11. The Trinity: A Philosophical Investigation.H. E. Baber - 2019 - London, UK: SCM Press.
The doctrine of the Trinity developed in response to a range of theological interests, among them the project of reconciling claims about the divinity of Christ with monotheism and massaging Christian doctrine into the ambient (largely Platonic) philosophical framework of the period. More recently the Trinity doctrine has been deployed to promote normative claims concerning human nature, human relationships and social justice. During the past two decades analytic philosophers of religion have increasingly engaged with the doctrine. There are, however, a (...)
  12. Adaptive Preference.H. E. Baber - 2007 - Social Theory and Practice 33 (1):105-126.
I argue, first, that the deprived individuals whose predicaments Nussbaum cites as examples of "adaptive preference" do not in fact prefer the conditions of their lives to what we should regard as more desirable alternatives, indeed that we believe they are badly off precisely because they are not living the lives they would prefer to live if they had other options and were aware of them. Secondly, I argue that even where individuals in deprived circumstances acquire tastes for conditions that (...)

Meet the meat: So, where's the beef?H. E. Baber - manuscript
Preferentism is the doctrine that "in deciding what is good and what is bad for a given individual, the ultimate criterion can only be his own wants and his own preferences." If preferentism is true then it would seem to follow that modifying a person's preferences so that they are satisfied by what is on offer should be as good as improving the circumstances of her life to satisfy her preferences. Our intuitive response to stories of life-adjustment through brainwashing, psychosurgery (...)

    Eucharist as Icon.H. E. Baber - manuscript
Presence as ordinarily understood requires spatio-temporal proximity. If however Christ’s presence in the Eucharist is understood as spatio-temporal proximity it would take a miracle to secure multiple location and an additional miracle to cover it up so that the presence of Christ wherever the Eucharist was celebrated made no empirical difference. And, while multiple location is logically possible, such metaphysical miracles—miracles of distinction without difference, which have no empirical import—are problematic. I propose an account of Eucharist according to which Christ (...)

    Freedom that matters.H. E. Baber - unknown
Ideologues of the American Dream doctrine assume that state intervention aimed at providing social safety nets for citizens and reducing economic inequality, restricts freedom and undermines individual opportunity. This assumption is the result of empirical misinformation and, more fundamentally, a conceptual mistake. Robust empirical data indicate that economic equality, far from stifling initiative or undermining opportunity, is conducive to social mobility.

Background The consistency of codes governing disclosure of terminal illness to patients and families in Islamic countries has not been studied until now. Objectives To review available codes on disclosure of terminal illness in Islamic countries. Data source and extraction Data were extracted through searches on Google and PubMed. Codes related to disclosure of terminal illness to patients or families were abstracted, and then classified independently by the three authors. Data synthesis Codes for 14 Islamic countries were located. Five codes (...)

Deciding for imperilled newborns: medical authority or parental autonomy?H. E. McHaffie - 2001 - Journal of Medical Ethics 27 (2):104-109.
The ethical issues around decision making on behalf of infants have been illuminated by two empirical research studies carried out in Scotland. In-depth interviews with 176 medical and nursing staff and with 108 parents of babies for whom there was discussion of treatment withholding/withdrawal, generated a wealth of data on both the decision making process and the management of cases. Both staff and parents believe that parents should be involved in treatment limitation decisions on behalf of their babies. However, whilst (...)

Globalization and International Development: The Ethical Issues.H. E. Baber & Denise Dimon (eds.) - 2013 - Peterborough, CA: Broadview Press.
This new anthology offers a wide selection of readings addressing the contemporary moral issues that arise from the division between the Global North and South—“the problem of the color-line” that W.E.B. Du Bois identified at the beginning of the twentieth century and which, on a scale that Du Bois could not have foreseen, is the problem of the twenty-first. The book is interdisciplinary in scope. In addition to standard topical essays in ethical theory by philosophers such as Anthony Appiah, Martha (...)

  45. The real presence.H. E. Baber - 2013 - Religious Studies 49 (1):19-33.
The doctrine that Christ is really present in the Eucharist appears to entail that Christ's body is not only multiply located but present in different ways at different locations. Moreover, the doctrine poses an even more difficult meta-question: what makes a theological explanation of the Eucharist a ‘real presence’ account? Aquinas's defence of transubstantiation, perhaps the paradigmatic account, invokes Aristotelian metaphysics and the machinery of Scholastic philosophy. My aim is not to produce a ‘rational reconstruction’ of his analysis but rather (...)
